The Law No. 6698 on the Protection of Personal Data ("KVKK") was adopted by the Turkish Grand National Assembly on March 24, 2016, and entered into force upon its publication in the Official Gazette on April 7, 2016.
The following provides basic information regarding the protection of personal data transferred to ASPA PAZARLAMA VE DIŞ TİCARET LİMİTED ŞİRKETİ (“LOVO”). LOVO presents these explanations to the attention of our customers and third parties using our website and/or mobile applications in order to fulfill its obligation to inform under Article 10 of the Law No. 6698 on the Protection of Personal Data (“KVKK”). LOVO reserves the right to update this Personal Data Protection Information text at any time within the framework of possible changes in the applicable legislation.
ASPA PAZARLAMA VE DIŞ TİCARET LİMİTED ŞİRKETİ, registered with the Ankara Chamber of Commerce under registration number 0324109455800001 MERSİS, located at Zübeyde Hanım Mah. Tesviyeci Cad. Seçim Sok. No: 67/A İskitler Ankara, is considered the Data Controller under the KVKK (Personal Data Protection Law) with respect to the personal information we receive from you during our activities. As the Data Controller, your personal information may be recorded, stored, updated, classified, disclosed to third parties and/or abroad where permitted by legislation, and/or transferred, and processed in other ways listed in the KVKK, as described below.
The Data Controller Representative to be appointed by LOVO will be announced in the Data Controllers Registry and on the website where this document is located, once the legal framework is in place.
1) What is the legal basis for LOVO's collection of personal data?
There are regulations in various laws regarding the use of our customers' personal data. First and foremost, the Personal Data Protection Law (KVKK) establishes the principles of personal data protection. Additionally, the Law No. 6563 on the Regulation of Electronic Commerce also contains provisions regarding the protection of personal data. Furthermore, criminal sanctions are foreseen in some cases for violations of personal data protection through the provisions of the Turkish Penal Code No. 5237.
On the other hand, the collection and use of data is necessary for the fulfillment of our obligations arising from the Law No. 6502 on Consumer Protection and the Regulation on Distance Contracts.

Data provided by our customers who make transactions through the LOVO.com.tr website or mobile applications is processed by LOVO in accordance with the consent of our customers and the provisions of the legislation.
LOVO.com.tr, owned by LOVO, is a website that uses cookies. A cookie is a file, usually consisting of letters and numbers, that is stored in the internet browser or hard drive of the device being used, allowing that device to be identified.

LOVO may record, store, update, disclose, transfer, classify, and process your personal information to the extent and in the circumstances permitted by law.

8) How does LOVO protect your personal data?
Personal data shared with LOVO is under LOVO's supervision and control. LOVO, as the data controller, assumes responsibility for establishing the necessary organizational structure and implementing and adapting technical measures to protect the confidentiality and integrity of the information in accordance with the relevant provisions of applicable legislation. Aware of our obligations in this regard, we conduct periodic security tests in accordance with international and national technical standards concerning data privacy, and we inform you that we always update our data processing policies within this scope.
9) Does LOVO share your personal data?
The sharing of our customers' personal data with third parties takes place with the customers' consent, and as a rule, personal data is not transferred to third parties without the customer's approval.
However, personal data is shared with courts and other public institutions due to, and limited to, our legal obligations. Additionally, personal data is transferred to contracted third parties in order to provide the services we have committed to and to perform quality control on the services provided.
Necessary technical and legal measures are taken to prevent violations of rights during the transfer of data to third parties. However, LOVO is not responsible for violations that occur due to the data protection policies of the third party receiving the personal data and within the risk area under the responsibility of the third party.
Your personal data may be shared with LOVO's shareholders, our direct/indirect domestic/foreign affiliates, program partner institutions and organizations with whom we cooperate to carry out our activities, domestic/foreign individuals and organizations from whom we receive cloud and/or server storage services, domestic/foreign organizations with whom we have agreements regarding the sending of commercial electronic messages to our customers, the Interbank Card Center, the banks with whom we have agreements, and various agencies, advertising companies, and survey companies in Turkey and abroad, as well as other third parties and relevant business partners in Turkey and abroad, within the scope of various marketing activities to provide you with better service and ensure customer satisfaction.
10) What are your rights arising from the Law on the Protection of Personal Data?
In accordance with the KVKK (Turkish Personal Data Protection Law), your personal data;
To find out if it has been processed,
Request information if it has been processed.
To learn the purpose of processing and whether it is being used for its intended purpose.
Knowing the third parties to whom it is transferred, domestically or internationally.
Requesting correction if it is incomplete/incorrect.
Requesting deletion/destruction within the framework of the conditions stipulated in Article 7 of the KVKK (Personal Data Protection Law),
Requesting that the third parties to whom it is transferred be notified of the transactions carried out in accordance with paragraphs (d) and (e) above,
You have the right to object to an unfavorable outcome resulting solely from analysis by automated systems.
We would like to remind you that you have the right to claim compensation for damages if you suffer harm due to processing that violates the KVKK (Turkish Personal Data Protection Law).
11) What is the retention period for personal data?
Although processed in accordance with Law No. 6698 and other relevant provisions, personal data will be deleted, destroyed, or anonymized by LOVO or upon your request if the reasons requiring its processing cease to exist. However, in accordance with Law No. 6563 on the Regulation of Electronic Commerce; records regarding the withdrawal of consent will be kept for 1 year from that date; and all other records regarding the content of the commercial electronic message and the sending will be kept for 3 years to be submitted to the relevant Ministry if necessary. After this period, your personal data will be deleted, destroyed, or anonymized by LOVO or upon your request.
12) How can I stay informed about changes in legislation regarding personal data?
Your rights under the KVKK (Turkish Personal Data Protection Law) are LOVO's obligations. We would like to inform you that we process your personal data with this awareness and to the extent required by the legislation, and that we will update this information on our page in accordance with new legislation in case of legal changes, and that you can easily follow these updates on this page at any time.
13) How can I be sure the data is kept up-to-date and accurate?
In accordance with Article 4 of the Turkish Personal Data Protection Law (KVKK), LOVO has the obligation to keep your personal data accurate and up-to-date. Therefore, in order for LOVO to fulfill its obligations arising from the current legislation, our customers must share their accurate and up-to-date information with LOVO. If your data changes in any way, we kindly request that you update your information by contacting us through the communication channels listed below.

LOVO may respond to requests within 30 days, providing a reasoned response (positive or negative) in writing or digitally. It is essential that the necessary procedures related to requests are free of charge. However, if these procedures incur costs, LOVO reserves the right to request a fee. These fees will be determined according to the tariff set by the Personal Data Protection Board in accordance with Article 13 of the Personal Data Protection Law.
